It was held that the provisions of the Public Officers Protection Act (POPA) do not apply to contracts for sale of land, construction contracts, claims for work and labour done and where goods are sold and the price is to be paid quantum meruit, the reason being that in all these instances refusal or omission to perform would be a failure to comply with the terms of the contract and not with the provisions of the statute.
