The accused aimed a blow at his brother with a heavily weighted axe, but turned away the cutting edge of the blade and struck him only with the wooden shaft. The brother still died. The court accepted that the man may have not intended to kill but it is still murder if it can be proved that the accused intended to cause “some grievous bodily harm”.
