Abacha v Fawehinmi

The respondent who was a legal practitioner was arrested without a warrant at his residence by six men who identified themselves as operatives of the State Security Service (SSS) and was detained at their office at Shangisha. He was not at the time informed of or charged with any offence. He appealed to the African Charter on Human and Peoples’ Rights but the Supreme Court held that the African charter cannot be superior to the constitution.
