Summary of Facts: the Plaintiff was described as sole selling agents in the contract. But the actual arrangement was that, lamb & Sons paid for the bricks at a discount and then sold them in their own name and at their own price.

Judgment: The court held that the relationship was not that of an agency because Lamb was selling the building materials after purchasing them from Goring
