Hyde v. Wrench

The defendant offered to sell an estate for 1000 pounds on June 6. On June 8, the plaintiff replied with an offer to buy the estate for 950 pounds to which the defendant rejected on June 27. On June 29, the plaintiff purported to accept the initial offer of 1000 pounds but the defendant rejected and the plaintiff brought action for specific performance. It was held that the plaintiff’s offer of 950 pounds was indeed a counter offer which destroyed the initial offer by the defendant. There was no contract and thus no obligations between the parties.
